2. Product Nature, Quality, and Use

MannaBrew is a natural coffee substitute made from the wild-harvested seedpods of honey mesquite trees (Prosopis).

• Quality Standards: Products are manufactured under international food safety management standards (FSSC 22000). On the Swiss market, the product is commercialized as a natural, wild-harvested food product without official Swiss organic certification.

• Usage Notice: MannaBrew coarse/fine grounds are not suitable for fully automatic coffee machines with integrated grinders. Heldner Import accepts no liability for machine damage caused by non-compliance with product preparation guidelines.

• Health Disclaimer: All health or dietary information provided on this website is for educational and informational purposes only. MannaBrew is not a medicinal product and is not intended to diagnose, treat, cure, or prevent any illness.

• Allergies & Intolerances: Heldner Import disclaims liability for adverse reactions, intolerances, or allergic responses resulting from product consumption. Customers must check ingredient lists prior to purchase and consult a medical specialist if they have known allergy risks or medical concerns.

3. Pricing and Payment Terms

• Prices: All prices are displayed in Swiss Francs (CHF).

• VAT Exemption: In accordance with Article 10 of the Swiss Value Added Tax Act (LTVA), Heldner Import is currently exempt from VAT due to an annual turnover below CHF 100,000.-. Prices are net; no VAT is charged or shown.

• Shipping Fees: Delivery charges are detailed before order confirmation. Shipping is free of charge within Switzerland and Liechtenstein for orders exceeding CHF 80.-.

• Payment Processing: Payments are made via secure, encrypted (SSL) payment gateways (Credit Cards, TWINT, or other methods offered at checkout). Heldner Import does not store or access your complete financial credentials.

4. Conclusion of Contract

The purchase contract is concluded once Heldner Import sends an electronic order confirmation and payment authorization is granted. Heldner Import reserves the right to decline or cancel an order in cases of unresolved disputes or manifest pricing/inventory errors.

5. Delivery Conditions and Transfer of Risk

• Territory: Deliveries are strictly limited to Switzerland and the Principality of Liechtenstein.

• Shipping: Orders are dispatched via Swiss Post or affiliated logistics partners.

• Transfer of Risk: Risk of loss or damage transfers to the customer upon dispatch. Packages are deemed successfully delivered once the carrier registers the parcel as delivered (including deposit in the recipient's mailbox or milk box). Heldner Import cannot be held liable for theft, loss, or damage occurring post-delivery.

• Address Errors: If a package is returned due to incorrect or incomplete delivery details provided by the customer, re-shipping costs shall be borne by the customer.

6. Finality of Sale, Returns, and Defect Claims

• No Statutory Right of Return: Under Swiss law, online sales are final. There is no general statutory right of withdrawal or return.

• Hygiene and Food Safety: For hygiene and health protection reasons, food items (pouches, capsules) whose original seal or packaging has been opened, pierced, or altered cannot be returned, exchanged, or refunded.

• Defective or Damaged Goods: In the event of a manufacturing defect or shipping error, the customer must notify Heldner Import within 3 business days of delivery by emailing info@mannabrew.ch with photo evidence. Verified and justified claims will be remedied via product replacement or refund.

7. Intellectual Property

All content featured on this website (including branding, graphics, photographs, texts, and recipes) is protected by intellectual property rights and remains the exclusive property of Heldner Import or its licensors. Any unauthorized reproduction, distribution, or commercial reuse is strictly prohibited without prior written consent.

8. Data Protection (FADP / nLPD)

Heldner Import complies fully with the Swiss Federal Act on Data Protection (FADP).

• Data Usage: Customer personal data (name, address, contact details) is processed exclusively for order execution, delivery logistics, and customer administration.

• Data Sharing: Data is shared with service partners (e.g., Swiss Post for delivery, payment processors) strictly to the extent required to fulfill the transaction. Personal data is never sold or rented to third parties for marketing purposes.

• Host & Infrastructure: Essential operational data may be stored on secure servers located within Switzerland, the EU, or the US under adequate data protection agreements adhering to Swiss legal standards.

9. Amendments to the T&C

Heldner Import reserves the right to update these Terms and Conditions at any time. The applicable version is the one in effect on the date of order placement.

10. Applicable Law and Jurisdiction

These Terms and Conditions are governed exclusively by Swiss Law.

The exclusive place of jurisdiction for any disputes arising from or in connection with this contract is Sion, Valais, Switzerland.
